The Freedom of Information Law (FOIL) provides the public access to certain school district records.
I acknowledge that I have read and understand my right to appeal a denial. I understand that all FOIL appeals must be submitted directly to the Superintendent.
Procedures and Timeline Pursuant to New York Public Officers Law §89(4), within ten business days of the receipt of a FOIL appeal, the Superintendent shall “fully explain in writing to the person requesting the record the reasons for further denial, or provide access to the record sought.”
Failure by the agency to provide a determination within this timeframe shall constitute a denial of the appeal. A person denied access to a record in a FOIL appeal determination may bring a proceeding for review of such denial pursuant to Article 78 of the Civil Practice Law and Rules.
